Yes, 1099 and gig workers in tipped occupations qualify for the $25,000 tips deduction. But three extra rules apply that W-2 employees never think about.

Rule 1: the deduction can't exceed your net profit

Your tips deduction is capped at your net income from the tipped business (income minus expenses, including tips). A driver with $18,000 of reported tips but only $14,000 of net profit after mileage and expenses deducts $14,000, not $18,000. High-expense gig workers hit this cap more often than they expect.

Rule 2: no SSTB businesses

If your self-employment falls in a "specified service trade or business" (health, law, accounting, consulting, financial services, performing arts, athletics), you're excluded even if clients tip you. A massage therapist at a spa qualifies (personal appearance category); a self-employed physical therapist (health SSTB) doesn't. Edge cases are genuinely murky, so when in doubt, ask a tax pro.

Rule 3: tips must be reported to count

For 1099 workers, qualifying tips are the ones on your 1099-K/1099-NEC or otherwise properly reported as income. App tips (DoorDash, Uber, Instacart) are reported automatically. Cash tips are on you to report, and now there's a real reward for doing so.

What it doesn't reduce: self-employment tax
